Confusing Contract and Dishonest Representation

Our story begins June 9. We signed the contract to put a pool on our property. We had experienced pool building before and understood most of the proceedure. We also went with the assumption that due to 0 negative remarks on this company there would be no problem.

We closed our loan on July 3... Ready to go! Was told the permits were waiting to be signed. And we would break ground. We had done our footwork!

July 16. Hobert Digs hole. Now, you asking why did it take 2 weeks to dig? Well, Hobert DID NOT turn the permit paperwork in til July 9. And we were told that everything was done.

July 17... Sprinkler system does not work through yard and was not capped. Also, back of fence was taken out and NO safety fence was placed. I had to call 4 times to get Hobert to come out and place fence... Worried about insurance!

July 19. I call sales person and ask why the sprinkler system was not capped? I then ask them when they will be getting this done? They tell me that it is MY responsibility, referring to contract. I asked them for clarification. They tell me that my responsibility includes Sewer & Underground Utility Rerouting. I then notified them that a sprinkler system is not an Underground Utility! They disagreed and told us that the contract was legit.

July 20 - 22, We ask several people within the organization what the definition of "Underground Utility" is? They inform us that this is NOT the first time for this issue to come up!!! We ask them why hasn't the contract been changed? We are they allowing this to be an issue. Clarification would resolve any dispute. July 22, we ask to speak to the owner, Mr. Hobert. We tell him via message that we are prepared to get a lawyer and file a complaint. He calls later in the afternoon. Tells my wife that he will walk away over $750 to reroute the sprinkler system. We have til July 23 to decide to resume the build.

July 23, given the choices and talking with other pool companies we have no choice to remain with Hobert to the end of the build.in talking with the several people inside Hobert, they are embarassed and ashamed that this has happened. They have also told us that they get into trouble over this all the time and that people don't like the verbage in the contract. It is unclear!!!

Mr Hobert, change that contract. Stand behind your staff and make pools the way your supposed to! You got rich off of making good pools... You may not need the money, but the ones working for you would like to get paid! Remember that when you knock on people's doors to buy a pool. (of course, not you personnally)
