David McCarroll Breached contract & no refund of my deposit

I have tried to do business with this company but they breached the contract. I paid them $1400 for a deposit in Oct and Nov for furniture which I have never received. David McCarroll, the owner, told me what a great deal I was getting by having them make the furniture that I wanted. He told me he could make what I wanted for less than half I would pay in a retail store and the quality would be much better. I had expected delivery by Christmas. The sectional which was ordered in Oct has never even been started and the bed which was ordered in Nov is just sitting on the warehouse floor incompleted as it has been for months. I have requested a refund of my money but my requests have been ignored. I have been given several delivery dates for the bed starting in March and the latest date in June. I called in June on the day it was to be delivered 3-4 times and left messages marked "urgent" and my calls are never returned. I also ordered a chaise which has not been paid for as it was not built correctly but has been delivered. I have asked him to remove this from my home and he said he could fix it but this still has not been done. I have been more than patient with this man and his company and if needs be will be suing in small claims court for my refund so that I can buy other furniture. I should not be without a bed since Dec and sleeping on the floor as I am Sr citizen and not good for my back. He blames this all on the passing of SB1070 as he lost all his illegal alien workers. Says they cannot stay here long enough to do the work. NOT MY FAULT!!! My only fault was trusting this company and not going to a reliable retail store. I would have had my furniture months ago if I had done that. I have always tried to do business with the small local companies but now I am not sure if I will ever trust small companies again. A registered letter was sent with my suggested resolution and asking him if they had any other suggestions that we could come to a mutual agreement. They never responded by the deadline date I gave them. They have refused to cooperate
