Ripoff sticks me with nearly $8,000 of furniture I can't return

I purchased 2 Ferguson and Copeland sofas and 1 chair that were delivered with cushions that did not fit properly. They flip up in the back and don't match the contours. I contacted Greg at Milton Homer who told me to wait 2-3 months so the cushions could settle in. I called and called after the two months and he eventually got back and said he would send his repair guy and the manufacturers rep. The rep never came.

It took around 4 months for them to give me the following options: 1. Send everything back and get new ones, but there was no guarantee the new ones would be any better. 2. Order new cushions, but they couldn't guarantee they would be from the same dye lot and they may not fit any better. 3. Add Velcro to the cushions to help keep the cushions in place but it still wouldn't align to the shape of the sofas. After discussing evaluating the options with me, Greg Thomson agreed to return all three pieces so I could select something from a different manufacturer and use the defective furniture until the new furniture arrive.

I had to wait several weeks for him to meet with me to make another selection, and after two more meetings, I realized he had nothing comparable to exchange. When I told him I found something at Macy's he said he would issue me my credit and pick up the furniture.

Two days after they took my furniture, I called American Express to make sure the credit came through so I could make my purchase. They told me no credit was issued. I contacted Milton Homer and eventually Greg responded and told me it was a STORE credit even though all along he led me to believe I was getting a charge credit. My faxes confirm this expectation as well.

I urged him to reconsider (which he said he would) and to return my furniture since I had nearly $8,000 tied up and nothing to sit on. He said he would give me some options in a letter when they gave me back the furniture.

I spoke with the Milton Homer customer service representative who slipped by saying I would have had a credit to my charge if the manufacturer would have returned them. Since they wouldn't, I couldn't get a credit to my card!

The furniture was returned in worse condition. Threading is coming up on almost all the cushions, one of the cushions is much flatter than the others, dark spots and there are scratches and indentations on the back of the chair.

Milton Homer proposed their final offer to me which substantiates the kind of deceptive practices I have experienced with them. Now, there is not even a store credit. They have offered to fix, which will void the warranty since Ferguson and Copeland because it isn't factory authorized! Certainly, if nothing was wrong, why was I able to return this in the first place? They offered to credit my charge only $1,000 allowance even though the defects and damage reflect more than $1,000. Originally, Greg offered to return all three items because he said they needed to keep everything within the same dye lot. (My credit slip supports this conversation and their new offer illustrates how they have made misrepresentations to me. Now, they will only replace the sofas knowing they won't match! (They damaged the chair sometime between returning to their store and bringing it back)

I believe Greg at Milton Homer intentionally delayed the return process in dealing with defective goods rather than dealing with it immediately when they arrived. He tricked me out of having the abililty to dispute my charge because the window of opporunity was gone as soon as I followed Milton Homer's advice by 'allowing the cushions' to settle! American Express told me to work with the merchant first and if they were not repsonsive then call them, which I did until when I realized they were not getting it resolved in a timely fashion.

Now, I have no recourse. American Express will make their decision at the end of the month, but I have been told they can't make the merchant credit my charge. I even offered to go half way and requested Milton Homer to put the Velcro on the cushions and I would live with the defects so long as they would credit my charge for half the amount which was around $3900 and they refused.

I think I have been victimized by a dishonest retailer and I have no hope of recovering my loss.
