Wraycon LLC, Aspen Fence and Deck Clyde Wray Fence company in VA - will not return to fix fence

We contacted Clyde Wray with Aspen Fence and Deck (under Wraycon LLC) at the end of May to install both a 6-foot privacy fence and a 4-foot split rail fence (both made out of wood) to contain our two dogs - a lab and a sheppard-lab mix. There were two gates - a 4-foot walk in and an 8-foot gate on the other side of the house.
In the contract it clearly states that the fence has to be up to Prince William County pool code as we were installing a pool this summer. Clyde and his crew showed up and did a wonderful job getting the fence in. Within a couple weeks, the 8-foot gate warped and would not close. We contacted Mr. Wray and he had a crew out the next week to fix it.
In August we had a pool contractor come out to give us an estimate. He mentioned to us that he didn't think that the gates were up to pool code. We notified Mr. Way via e-mail and he send back an e-mail stating that the fence was up to code and if it wasn't, he'd be happy to come out and fix it.
Two weeks later the county inspector come out to inspect the pool and the fence is not up to code. The latches on the gate are not the correct ones and the slots on the gate are not 1 inch or less apart. We contacted Mr. Wray, both via e-mail and phone. We had a hard time getting him to return our calls or e-mails. When he finally did, he promised that he would have someone out to fix the fence the next Tuesday. It has been 3 weeks and there has been nobody to fix the gates, Mr. Wray refuses to reply to our e-mails and phone calls.
We feel that Mr. Wray was aware from the beginning that he was installing a fence that would not pass inspection. Please, do not fall for his "small business owner who will do you right" talk!
We have already made sure that at least one other person did not use Wraycon LLC for their fence project - the pool company was installing a pool at their house and warned them against Mr. Wray.
In addition to the issues with the pool codes, the fence is also giving way on one side of the property, allowing our Lab to easily push her way out of the fence and run away. We have not found a solution to this issue and, again, Mr. Wray is not returning phone calls.
We intent to sue Mr. Wray for the cost to have the fence fixed in order for it to pass the county pool inspection and keep the dogs contained. For a $7000 job, you would expect a better job. My husband and I have always believed in supporting the "little guy" but this has made us very, very wary of small businesses.
