Construction and remodeling fraud

Construction & Repair

We met with Brian Weinstock after seeing his impressive performance rating. He is good sales person, we were sold the idea that he is going do a lot more than anyone else would (we should have known better). We were hoping to build 2 car garage a new kitchen, family room, 2 bedroom and 2 bath and remodel parts of our existing home We signed a contract with Brian Weinstock of Home Installation Professionals (Watertech, Inc.) in July with construction to begin November. The price agreed was $225,000. After kitchen design completed Brian told us that our kitchen will cost about $10,000 more than what he has allocated. We also agreed (sold) to remodel our master bedroom for another $15,000 bringing the total project cost to $250,000.

Early November Brian start the demolition of the old area at which time he asked for 1/3 of the payment, We had agreed paying him 1/3 because he was suppose to pay for various materials including lumber to make our custom wood siding. We end up paying him about $80,000. Shortly a few days after the work began he called me saying that his line of credit has dried up so it is best for me to pay the subcontractors directly. I asked him about the $80,000 that I have paid him, he provided me with a copy of the vendors and subcontractors that he has pre-paid them. I continued paying all the ongoing work directly including the materials.

On December 28th an employee from the Village of the HP showed up in my door and requested for the work to be stopped for the reason of work permit not being paid. They also told me that in order to get the permit re-stated we have to pay the city with certified check. I called Brian asking him what is going on he replied that there were some issue his bank and he will take care of the permit later on the week? I contacted building permit official and I was told that MY BUILDER HAS GIVEN THEM CHECK MULTIPLE TIME AND THEY HAVE BOUNCED. When I contacted Brian again he told me he does not have the fund to pay the city. I paid the city and continued the work by paying the subcontractors directly. I contacted everyone on the list that were supposed to be paid by my $80,000 concluding that he has only spent couple thousand on my house.

Since the demolition and start of the construction I have been paying for materials and labor for every work goes on my house. Brian has been getting money from home owners like me not paying any of his subcontractors blaming it all on the economy and I am not patient?
He has abandoned my project, claiming to be going bankrupt and I can do nothing to get my money back or finish my house!

We (my wife and my two kids) are left in a half destroyed house. The subcontractors have agreed to finish the project at cost (to help my family).
