I paid for merchandise that has never been delivered or ordered

I ordered 10 dining room chairs in September, promised to be delivered before Thanksgiving. Their delivery has been promised every week since before Thanksgiving. They supposedly are on their delivery truck now for the last 3 weeks out of state because it broke down.

I also ordered fabric in December that never has arrived and I was told it was sent 3 times by UPS - the fist shipment was lost, the second never was sent by the company, the third wasn't sent because a flaw in the fabric was found. I was promised I would have it before Christmas. I never get a message from this company - I call to find out where my merchandise is located and I just get lies.

I have spoken with another area designer and have been told they know of at least 10 other customers that have had to take this company to court because they did not receive their furniture either.

He has promised to pay me the total dollar value plus 10% for my trouble last week and then when the chairs were not delivered, he refused to pay. I was promised again to have a full refund if not delivered today - and the chairs were not delivered.

I have rights as a consumer & this company is taking people's money (he has $16,000 of my money that I have not received my merchandise for) and never ordering the products. Help me.
