Furniture fabric is pulling away from the frame. They do not want to replace

We bought our furniture with spot protection only 4 months ago. Rep came out after we filed complaint. The furniture is waring as if it were 6 or 7 years old. The fabiric is actually pulling away from the frame and gapping. They rep said he found no problems. I am planning on taking them to small claims court if they do not replace.
