Defective product theft refused refund

I ordered a plumbing fixture from homecenter.com. When it arrived I noticed that the box had been opened previously. Some of the parts were missing. I shipped the item back to homecenter.com with an RMA number and via a tracked UPS shipment. They received and signed for the item, but have refused to give a refund. They have my money and the item. Their customer service person promised that my refund request would be "sent to accounting" but after four months, there is no sign of a refund coming even after repeated requests. To me, this is basically pure theft
