The Plaintiff, JAMES F.B., asserts that the Defendant, EDGEWATE SHEDS, is a business operating in Anne Arundel County, Maryland.

On May 11, the Plaintiff entered into a Contract with the Defendant to purchase two out buildings. The customer service person, Will, advised the out buildings would be delivered in four (4) weeks to my home at 5604 Dover Street, Churchton, Maryland. The Plaintiff made a deposit of $2,600.00.

In the middle of June, the out buildings had not been delivered and the Plaintiff called the company to inquire. The person answering the telephone said that there was a problem getting the out buildings into my yard and said a representative would come to my home to talk with me about the out buildings. The Plaintiff told the representative to cancel the order. The representative said there would be a 20% fee to re-stock the out buildings; meaning the Plaintiff would lose approximately $1,000.00 of the deposit.

Bill Bryant, who identified himself to the Plaintiff as the owner of Edgewater Sheds, came to the Plaintiffs residence to survey the ability to move the outbuildings onto the property. Mr. Bryant said that a privacy fence would have to be moved and would be returned to its original position after the placement of the out buildings. Mr. Bryant told the Plaintiff there would be an additional cost of $1,000.00 to move and replace the fence. I told Mr. Bryant I would have to give the idea consideration and would call the office. I also expressed a concern of losing the aforementioned monies for a re-stocking fee. Mr. Bryant told me not to worry about the re-stocking fee and all monies would be returned if I decided not to purchase the out buildings.

Several days later, I contacted Edgewater Sheds and told them I could not afford the extra monies needed to move the fence and to cancel the order. I asked for a refund of my deposit and was told the re-stocking monies would be deducted and I would receive the balance. I explained that Mr. Bryant had waived the re-stocking fees when he was at my home surveying the property. The person who answered my call said he would talk to the owner and call me. I asked that Mr. Bryant call me.

I never received a return call from Mr. Bryant.

I called subsequently and was told I would be assessed the re-stocking fee and a check would be sent.

On July 3, I went to Edgewater Sheds and saw Will, the customer service person. Will told me that he knew the check had been sent to me with the deduction for the re-stocking fee. I told Will I had never received the check.

On July 7, I received a check for $1588.00.

I request that the Court order the Defendant to refund the balance of the deposit.

The Defendant failed to notify me of any problems while awaiting installation of the sheds and when Mr. Bryant came to my home, he waived the re-stocking fee. I could not afford the move of the fence and should not be penalized for the Defendant selling me delivered sheds without first surveying the property to determine that access could be made. Additionally, the Contract does not indication a twenty percent (20%) re-stocking fee if the order is canceled.
