False Advertising

I purchased three dwarf fruit trees from their catalog.in the catalog it said the trees were 2-4' tall and cost $4.99 each. The trees were ordered 4/16/07 as part of a full order costing $42.57. This was paid for with my Master Card from Citibank.

I received part of the order as promised with a note that the dwarf trees were on back order. On approximately 5/12 UPS delivered a 12" Box from Honeycreek Nurseries that contained our three trees! Upon opening the box we found three dwarf trees of 4"-7" tall. The ad showed the trees in what appeared to be a nice ceramic container. They arrived in small 4" Plastic Boxes.

I tried to contact Honeycreek via email but could not get any answers. I then got another email address and finally made contact with them. I asked that we be sent the proper product as promised. After about four emails back and forth I was asked if we had opened the box and if we still had the trees. I said yes to both. I was then told in the email that I needed to send them all the correspondence I had with them from the beginning of the dispute. This was impossilbe and I said that instead I could just send the original trees back. I waited two more days and did not hear back. I then got mad and told them to just forget it and we would find someway to deal with the trees. Right now we have them planted in small window containers on our window ledge inside the house.

This type of thing must be stopped. This is a large company, a division of Burgess Seed & Plant Co which is highly respected. I have to think that the problem lies in the people actually running this portion of the company. I would like to receive the original trees as promised along with prepaid postage to send back the ones we have.
