New home rip-off, construction defects, builder not providing warranty

I bought a brand new home in 2004 for $715,000 from the Pasto Inc. We spent $30,000 on upgrades and the developer added this to our loan. One of the partners of the company sold my home in order to buy his home. We feel that this was a conflict of interest and feel we were forced to sell in order to buy. He was only looking after his benefit. We regret selling our beautiful 5 bed/4 bath home with a swimming pool for this new home. During the first year, we experienced a long concrete crack down the middle of our 100 feet long driveway. We reported this to the developer and he did nothing about it. Over 6 months, the crack got wider and I decided to seal the cracks to prevent further damage and because of the rainy season. Come to find out, the developer failed to place re-bar to prevent the cracking. After battling with the developer, he finally removed the cracking section and repoured the concrete. Just recently, we experienced another construction defect in the master shower. The developer incorrectly installed the shower pan which resulted in mold, dry fungus, and deteriorated the walls. The cost to remediate the mold was $9,000. My insurance company denied my claim due to the developer's faulty construction. I notified the developer and he denied responsibility. This has created a financial hardship and I had to take out loans and withdraw from my retirement savings.
