Stole 1097.47 for down payment on tiling a bathroom and installing a shower enclosure. No work performed. Ripoff

We signed a contract with Kevin Hayes on March 26 to have tile installed in a shower stall and around a bathtub. The work was to be started on Thursday March 30th. We picked out tile from Lowes website and the contractor called from Lowes to state the tile was unavailabe and would take three weeks for a new shipment to arrive. We waited three weeks for the tile to arrive. He called on April 13th and left a message that the tile was in. We returned his call on April 14th and left 2 voicemails. He called back twice and each time we answered the phone he hung up. We have called him three times since April 14th attempting to reach him. On the third call we stated the tiling must be completed before the end of May because we have family coming to visit. We also stated if he did not perform the work or return our money by April 24th we would take legal action.
