Ripoff, Received down payment and never did any work

After doing much research on ICS Steel Buildings and Sam Cover (owner) we decided he would be a good contractor to hire to build a attached garage. I researched him on the Washington State Labor and Industries web site and also in court house records. He came up clean and we met with him at our home. After a extensive and long meeting we gave him the drawings our engineer had drawn up and a down payment of 4200.00 (this was 1/3rd of the total price) This was in December. We never heard from him for about a month. We would call and leave messages and never get a call back. When he did call he would promise to come and start the garage. I checked daily with the permit department at the courthouse and he never applied for one.

About 3 months later he stopped returning calls. This is when we envoked our lawyer. All we wanted was our down payment back and now after more than six months of his lawyer jerking our lawyer around we filed the lawsuit and want lawyer, court costs and down payment. We got a letter from his lawyer saying he no longer represents Sam Cover and we need to direct all correspondence to Sam now. Also found out he has about 5 other people suing him for the same thing. He takes your down payment and uses it to pay other bills and such and then doesn't have the money to get your supplies and start the project.
We recently found out he has done this in Tacoma, WA and that is why he came to Spokane. Also found out he is trying to file Chapter 11 and has had his business license pulled by the State. He is a smooth talker and makes it sound good and the price is right. Never does the work and "takes from Peter to pay Paul".

Do not sign a contract and give him money. Don't do business with him, he is a fraud.
