Gwinnett Place Dodge down payment ripoff scam

I was in the market for buying a new, I found a 1999 E320 Mercedes with around 92,000 miles on the Internet at Gwinnett Place Dodge for $16,900. My husband and I went to the dealership on July 7th to apply for a loan for the car. We got a call from the sales manager (Adrian Singletary) on July 16th that they had found us a bank that will finance the car, (Automobile Acceptance, Riverdale GA). Mr. Singletary asked us to come in on July 17th at 3:00 to pick the car up. The Sales Rep who helped us was Tony F. Upon completing the paperwork they first told us they will give us $3500 for our trade but later said they will only give us $2500. They wanted us to put down $3500, which we told them that we only had $2000 now and $1500 we had to post date for a later date. The sales rep filled out the application, we provided all originals of our paycheck studs, etc.

We got a call on July 27th saying that the contracts we completed were outdated and we needed to come in to do another contract but all of the information will stay the same. We went back to the dealer on August 8th to sign the new contract.

In the mean time Automobile Acceptance, Riverdale GA has called all of our references and called us to go over our credit report, when and where to send our 1st payment etc. All this was done around July 26, - August 6, at that time we were told by the finance company that everything has been completed.

On August 19th I got a call from Adrian Singletary/Sales Mgr to bring the car back immediately or they will have a repossession company to pick the car up and have it reported as stolen, I also have a recorded message at my place of employment from the General Manager Mr./Tim Nelson saying he is going to report the car stolen if I did not have the car back on there lot in one hour, we immediately delivered the car back less then 28 minutes
Once we arrived at the dealership, Mr. Adrian Singltary stated that the finace company changed there mine about financy the car because when they called our mortage company it did show that I july mortgage payment was in. I had proof where the check cleared my back etc. But the dealership didn't want to hear that. Mr. Sinltary and a nother co worker went out to look over the car and to record the mileage (94,549) and demanded all of my paperwork. He told us they sold our trade (1993 Chevy Pick Up) for $750 and they will not cut a check for the cash money we put down. ($3500). He said this could take a month or two months before we can get any money back if anything.

On August 19, I also spoke with Automobile Acceptance who original gave us the loan; they stated to me that the reason the contract was denied was because our July mortgage didn't show that it was paid when they called. I told the gentlemen that I had proof that my mortgage cleared my bank for my July mortgage. He told me I needed to call the Senior VP.

On August 19th I spoke with the corporate office for Gwinnett Place Dodge, NC/Angie She said I needed to speak with Tim Nelson who is the GM at that location and there is nothing she can do for me. I gave Mr. Nelson a call; he immediately became very cruel on the phone. I still can't belive this man who supposed to have been the GM was this rude to me over money they owe and they sold my car. He stated that I stole the car, he told me the only way I'm going to get any money back is if I get an attorney, you have your attorney call my attorney and hung up the phone on me.

As of this day August 31, this company has not returned my trade nor has it given me any of my money that was given.

This car is registered and titled in my name. As Mr. Nelson stated, that the only way I'm going to get any money is hire an attorney in regards to this situation, I can't believe Mr. Nelson is refusing to do anything. His reasons for not returning my money is I ran up $7500 worth of mileage, cleaning and detailing of the car, which is the amount of the down payment and the amount I was given for my trade. We had this car for almost 2 months! This is shocking to see that a company as huge as this dealership would put its reputation on the line for this amount money. Now I've had to hire an attorney to get my money back. I can't belive no one from the corp office is calling in regards to this matter. To top this off, I had a friend to call the same dealership to asked about the same car that was still listed on the internet, a salesman by the name of Adam Jackson said to her that they still have the car and the miles are 89,900 when I purchase the car it had 91,899, when I returned the car it had 94,549. My friend and her husband went to look at the car, they went to the new lot but was told that the car was at the used car lot and to walk over while he go and get the keys, he comes out with three other gentlemen's to say they just sold the car in a auction. It sounds as the miles have been turned back and they got suspicious about them coming to see the car.
