Refused treatment in uninsured motorist claim

In 2003 I was a passenger in my parked car in a store parking lot in Coos Bay, OR. An uninsured motxorist with no registration hit the car from behind. Progressive paid me for my bumper less deductible. My low back hurt but I said I wanted to see if it worked itself out. The adjuster said not to worry—I had up to a year to seek treatment. Six months later it was still hurting and I said I wanted to get it looked at. They said I waited too long. Fortunately, it stopped hurting over the next six months. They also told me they were going to take action against the motorist. They did nothing.
