Takes deposits, doesn't do job, doesn't refund deposits California

On the 4th of November I hired the auto shipping company to ship my car from Millis, MA to Tulsa, Ok. I explained to them that I was in Baghdad, Iraq and would not be in country until the 02 of January.

I send this company the deposit and signed terms and conditions as they requested. The check was cashed on the 10th of November and I was told in an email that the car would available for the week of the 24 of November.
After thanksgiving the car was still not picked up and my emails where not being answered so I called. And I was given the promise that the car was going to be picked up within two days.

There was a winter storm in the area so I gave it another week. She even called the company were the car was located and told the company that she was going to have the car picked up in a few days.

On the 12th of December I called and she had me call her dispatcher who told me that she was having problems locating a truck that was going in the direction of my car and that if I was unhappy that I could cancel the contract.

All I wanted was a date that my car was going to be pick up. On the 15th of December there was no date of pickup so I fired the auto shipping company and hired another company to ship my car. The auto shipping company refuses to refund my money.

I want my deposit back from this company I feel that they have taken advantage of me. They have lied to me. And they were not able to complete a job that they accepted money for.
