Threatened with repo on credit report after returning car within a week

On 11/20 I bought an used car from Almazan Kars Motor Sales in Los Angeles. The car can't pass the smog check and I won't be able to register the car to drive it legally on the streets. Westlake Financial in less than a week approved my loan which is fine but on 11/30 I went and return the car because of the issues with the car to pass the smog which means I won't be able to drive it like that on the streets. I called Westlake Financial and they told me the I can't cancel the contract because I already signed and I will lose my down payment and on top of that they will show the car as a repo on my credit report... When I only had the car for a week and they know the problems with the car and still won't cancel the loan for me. I paid $1000 dollars with a check which was cashed right away and they won't give me any money back from those $1000 dollars i paid. Please if anyone knows how to legally process this company I would appreciated. Please get back to me as soon as possible thanks
