Deceptive ripoff dealer on Marthas Vineyard

We purchased our car from Mr. Ken Efron of Bertel Auto Brokers. Their address is 10 Hye Rd. Edgartown, MA 02539. We did not pick or purchase the car at that site, however, we picked up the car and signed the paperwork at Mr. Efron's brothers home in Sharon, MA. Edgartown is on Martha's Vineyard.

We sent a 30 day demand letter to Bertel and Mr. Efron. Their lawyer responded by denying any liability. Bertel offered to arrange an engine replacement for $2,500 at our cost. We replied that we would be willing to split the cost, but we wanted to use an engine rebuild co.in Canton, Ma. They sent an estimate of $2,800 including 1 year warranty for parts and labor. Bertel rejected this counter offer. Their reply was that since we did not get a rejection sticker until May (true, we were too excited
to notice that there was no sticker at all on the car, giving us double talk, distracting us, saying how great the car is and how they will take care of any problem if one comes up.

We purchased the car in December it negated the return policy statute. We were not interested at the time in returning the car only in getting the engine fixed. It was our error not to get the car inspected within 7 days but the consensus at the time from two mechanics is that it probably would have passed. The check engine light did not come on until we embarked on a long distance drive on the turnpike to Vermont.

We are contemplating small claims court. We were waiting for a response from the dealer's lawyer. They blew us off.
