Ripped off by DiFeo Auto. Single Mom w/baby, distraught and needed a car was taken advantage of

I purchased a pre-owned Ford Escape from DiFeo Auto on Communipaw in Jersey City in December and I ended up trading it back in within a month because it did not drive well and I felt as if I would have a major accident if I kept the car. It would take off with a little press on the gas peddle. Anyway, DiFeo agreed to buy it back but I was told that they would give me fair market value and of course there would be a depreciation. Ok, I aggreed to pay the different and trade it in for something that was safer so I I paid $3k to them so they can pay the bank off. I wrote the check out to them for 3,500 plus the additional money as the down payment on my new vehicle (Mountaineer) which was $5,300 for the 2005 Mercury Mountaineer. To make a long story short. The bank never received the $5k and had no record from the dealership as to a down payment for my new vehicle. So where did my hard earn money go? The bank quoted me the full amount I owe on the vehicle $16K... Original. I starting calling the dealership back since last week and have been passed around, disconnected, sent into voicemail, leaving messages with no called back from anyone. To add to my frustration and the fact of over $5k of my hard earned money as a single parent with no support is gone, I found out that they ripped me off and sold me the Mountaineer for $16k something when I saw the add on their site and printed it out and took it to them for $13k something. When I presented the printed add, they blamed the person who listed the Mountaineer on the site and said it was their error because it should not have been $13k it was an error and should have been $16K. After doing some research, I see that for that make and model/year, the initial listing of $13k something is what I should have purchased it for. If anyone out there can help me get my $5k in the right place which is with the bank. Please HELP!
