On November 8th I left a depost in check form of $100.00 for the purchase of a Vehicle with the understanding that if I were not happy with the terms and condition of the purchase my deposit would be returned to me. The check was not to be deposited but to hold the vehicle and applied to the purchase price in the event I accepted the banks offer. I received the and turned down the banks offer on 11/12/08. I requested my deposit back from Wagner (Sales rep) and he advised me that the check was already deposited (without my knowledge). He advised me to contact him the following day to get a refund. I called and spoke to a women who refused to give me her name but she advised me that she's the owner. She told me that my check was deposited for the process of paperwork. I advised her that was not explained to me when I left the deposit. After a second phone call, she advised me that it was her decision if my deposit would be returned and at this point she will not return the deposit and there's nothing that I can do, and if I want my money to get a lawyer and sue.
