On April 14 My husband and I walked into a dealership called Newport, interested in seeing a BMW we saw parked in the lot. When we inquired about it we were told the price was a little bit over $9000. Because it was too expensive we asked if she had anything else, to which she replied that she had an M5 at the other lot. We saw the car and my husband was in love. He signed his name to the paperwork, and gave a deposit of $4500.00. I asked the sales lady for a copy of the contract and bill of sale, to which she replied that after I brought her 12 postdated checks that Saturday, she would give me a copy of the contract.

I thought it was weird, but assumed that maybe that was how it was supposed to be. We left and the following day the car kept turning off, and having problems. We went to the dealership to complain, and they told us they would fix it. They fixed something that was wrong with the catalytic, and we left. Upon leaving the car started to smoke now so badly it looked like we were fumigating for mosquitos. We took the car back, and left it there asking for a car to drive in the mean time.

When my husband went to work, he decided to run the vin number on the car, so he could get the color code of the paint, because he wanted to paint it (the paint was a bit dull). We found out what they sold us was not an M5, even though the emblem on the back said it was, it was actually a 540i. Now we were pissed. We went to the dealership demanding they give us back our money because they were committing fraud, for selling us a car under the impression it was an M5, and not a 540i. They of course refused, so we decided to report them to the Department of Motor vehicles. I talked to them and was told I would need a copy of the contract, so we went to the dealership with 12 checks, and gave it to them so they would give us the copy.

When I asked for the copy, they must have caught on because they proceeded to white out the part that said M5 and wrote in 540i, on the already signed contract. I explained this to the DMV, but because I had no original, there wasn't much they could do about it, even though I had the temporary tag registration that said M5, the key tag they gave us with the key also said M5, and pictures of the car with the M5 emblem on the back. They also inspected the vehicle themselves and saw the emblem.

Still with all this evidence, they could do nothing, so I reported them to the BBB, and hired an attorney. I am now going to small claims court to sue them for auto fraud. I found out that the name of the company Newport enterprises corporation was administratively dissolved about 2 years ago, however my bill of sale has their name on it. I think that's pretty illegal, since they are no longer registered as a business. I also found out it is illegal to ask someone for post dated checks. The BBB, asked for a response twice, and still they did not respond. This is listed under their website now, with an F rating. I will post a follow up when I get more info.
