Kept 330.00 for item purchased... Kept 25.00 packing fee never sent merchandise

I purchased a moped from seller on ebay with the agreement he would pack it for shipping. I paid him 25.00 for packing. Both shipping agent and myself gave specific instructions for packing (based on Roadway express guidelines). Seller agreed.

When he arrived at shipping terminal Roadway would not accept for shipment because he failed to pack it properly. He threw a temper tantrum and stormed out of Roadway terminal. Now he refuses to ship at all (knowing that I can not come and pick up item myself) and is beligerent.

I have requested a refund of the money but he refuses. It has been over two months (began on june 5th). Ebay is useless in trying to resolve. IC3 is useless. Postal mail fraud division is useless. I am now trying to get the police and DA in his area to do something. I am not hopeful.
