Cactus Jack's Auto
Deceptive Practices

Cars & Transport

In 2003 I purchased my third vehicle with Cactus Jack's Auto. My third vehicle was a 1996 Saturn. They say the third time is a charm. Well in this case it sure was! I purchased received a lemon for a vehicle. From the first days that I drove off the lot with it I had nothing but problems.

First it was the check engine light, but that was supposedly just the censor that was off. Then I had gas leaking onto my engine not to long after that. And finally the third and final straw was the car just completely died on Chandler Blvd near Mclintock about 7 miles from my home and let me say it was a long walk home! I contacted Cactus Jack's immediately to notify them about their car and that it needed to be picked up ASAP.

According to a man that tried to assist me and stated that he was a mechanic said "it looks like your engine locked up". So when speaking to an employee of Cactus Jack's I did say that there was a possibility that the engine may have locked up. They said they would take a look at it once they had their tow truck come and get it.

In the meantime, they did claim that that looked like the problem and that and that they could fix it but I would have to come out of pocket! I said are you crazy! I have only had the car for a few months and have had nothing but issues and now you want me to come out of pocket even more. No way! So I said they could keep it.

Five years later I received a call at work it was Ms. Gaines from the "legal department" of Cactus Jack's saying that I owed for this vehicle from 2003 and I need to pay $5400 that was left on the balance. She said that they sold the car for $500 and that was the remaining balance. I said you are calling me now five years later. There has been no previous attempts to collect on this before so why now? She told me that they will garnish my wages if I don't take care of this immediately. I advised he I don't have the kind of money, she then proceeded to say well you are a Training Coordinator so you get paid well. What happened to the good old FDCPA laws..
She proceeded to contact me at work day after day and sometimes leave 3 voice mail messages per day! She even threatened to get my employer involved and that same day she called my boss and left her a message. My boss was furious. I then sent a cease and desist letter to them and my boss called them as well to adv them that I could not be bothered at work. The calls stopped.

Now I have been subpoenaed to court by them two months after they said they tried to serve me at my residence! I was horrified when a man from HR had to contact my manger to serve this to me. Ho embarrassing! So I can meet them in court after filing some paperwork and sending $39 to the courts or I can just allow them to place a judgment on me! I have worked so hard to regain my credit and now so many years later this crooked company wants to take that away! I don't think so!

I hope this a learning lesson not to purchase a vehicle from this company without getting your vehicles thoroughly looked at by an outside mechanic.in that case I am sure if you do that. You will decide not to purchase a vehicle form them!
