Deliberate and malicious false reporting of credit / crediting payments to other individuals' accounts

In December sent payment on my account with Capital One. They cashed the check but did not apply it to my account. I did not find out until January of this situation. I had to obtain cashed check stub in order to receive proper credit. However, Capital One marked that I was 30 days late on credit report and never corrected my file to reflect their mistake.

In May I sent in a payment on my account.in July, received phone call they were going to start repossession process because they had not received anything since April. I informed them that I had sent payment in May and was going to send payments for June and July. Once again, I had to obtain the cashed money order in order to prove payment. Once I again I received credit but the never updated credit file to show that I was not 90 days late.

On Jan 10 I went to purchase new vehicle. I was told that Capital One was reporting to TransUnion that I was $1286 and 4 months past due. (I have been current and on-time with my payments since December.) On January 11th, I called Capital One to seek resolution and was told that there was nothing that I could do about the matter (and was treated very rudely).

I filed a complaint with the Better Business Bureau on January 11. On January 14 was told by dealership that my TranUnion had been updated. The report now showed that I had a balance of $17,000 on the account, with $4,000 past due and I was 4 months behind. Capital one has deliberately and maliciously changed my report negatively within the past 72 hours.

Both the dealership and I have tried to contact Capital One and keep getting disconnected every time. I plan to seek restitution.
