Deceptive advertising practices and failure to remove address from contact list when requested

I received a "final notice" letter in the mail from Automotive Financial Consultants regarding a warranty notice. They claimed my vehicle's warranty was either about to expire or had expired and that I needed to call them within 72 hours (866-538-1212).

When I called they had no information about my vehicle specifically. I asked to speak to a manager and had to argue with the person on the phone to be allowed to do so. He kept telling me the managers were too busy with other customers and I should just let him help me.

Having been "helped" by other reps before, I insisted on speaking to a manager. When I was finally allowed to speak with someone who said his name was Jim LaBarbara and who said he was a manager there, I requested the manager remove me from their mailing list and add me to a DO NOT CONTACT list so they will not contact me even if they repurchase a new contact list that some how manages to re-add my name to their list.

He said they can't do that (um, yeah, you can and you are required to if someone requests it), but said he would convey my concerns regarding their contacts as well as the legitimacy (or lack thereof) of their business to his boss. He gave me what he said was his direct contact line 877-304-7906 and I assured him that if I received any more of these mailings I would not only contact him directly but I would also be inclined to further investigate if appropriate legal or governmental overseeing groups should be contacted about the legitimacy of their business practices.
