Daniel Nieto And Jamie Damage to an 81 year old's vehicle they are refusing to fix

My mother called me and said her car was having problems. I looked at it and I realized it was the transmission. We had purchased an extended warranty on the car and the transmission was covered. This is how I was referred to Cottman's Transmission. They got the car in and said that the transmission would need to be re-built. As it turned out the warranty would not cover all of the repair to the transmission.

It took nearly two weeks to get the car back because we were waiting for a check to arrive. I had asked if I could just pay for the repair with my Visa and when the check came they could sign it over to me. Jamie, the manager called whoever he reported to and said I could but it would be an additional 3%. An additional three percent to pay with a credit card? I decided not to pay the 3% on top of the other 1300 plus the 730 they were receiving from the warranty.

I politely declined. I decided that this was not right and I went back up there and said that my mother was 81 she needs the car and I shouldn't have to pay 3% for using the Visa. He said okay let me call my boss again. He called again and said, "yeah he will let you he was just in a bad mood yesterday." Astounded, I came back after work to pick up the car. When Jamie pulled it around he pulled it to the other end of the parking lot. He handed me the keys and when I went to get into the driver's side back rear panel was damaged. It appeared to be hit with a large object, like another car backed into it. When I asked how the car got damaged he said he did not know and went out and looked at it. He said he would talk to his employees and the former manager Daniel Nieto who had just left this location to manage another Cottmans location since my car had been in their posession.

When I went back Tuesday and they told me they would not accept any responsibility for the damage because I could not prove that it happened there. I had taken a picture in front of the manager Jamie and pointed it out and he agreed. So now I am stuck with a my mom's car damage and they won't pay for it! After Jamie told me they would not accept responsibility and I needed to talk to Daniel, Daniel said the same thing until I told him what Jamie wrote on the contract and that I had taken a picture of it. I also advised that if my mom did not need the car I would not have taken it. At this time nothing has been done. I am going to take the picture to Daniel and give him the opportunity to fix what his company damaged and then I am going to the corporate office to settle this dispute. If there is no relief I will be forced to take legal action.

I am very frustrated but still hope that Cottman's will do the RIGHT thing.
