Ripoff sold us unsuable engine and unusable warranty

My husband and I purchased an engine for a Toyota Tercel that my daughter drives while she is at school, 300 miles away. When Mario, the mechanic that we hired, received the engine, he called us and asked us to come over and look at it. We did. He pointed out that the engine was severely rusted, the cams were pitted because of this, the oil pan was dented (even though the pallet that the engine was still attached to was in perfect condition), the balancer was rusted on, the guide pin from the old torque converter was broke off and stuck in the back of the crank and there were a few other things that he said he could just take off of our old engine and replace.

We call ASAP's warranty dept. And talked to Wade. He said he needed to talk to my mechanic. I had Mario call him and Wade said that he would get it approved and have something faxed to Mario so that we could ship the engine back. Mario did not receive a fax that day (or yet). We have called several times, talked to Wade, talked to Ben, talked to Dina (who says she is in charge). They state there is nothing wrong with the engine and they will do nothing to remedy the situation. Dina did state that we could pay to have it shipped back and pay to ship another one out.

Needless to say, the engine still sits at Mario's shop. Why did we pay $160 for their six month warranty? We have since purchased an engine elsewhere since school will be starting in less than a month and our daughter needs a car. We had our credit card company take the price we paid for the engine and the warranty off of our credit card. But I'm sure ASAP will have an answer for that. That's okay, we're ready. We took pictures and videos of the engine and had another mechanic come over and inspect it. He has written a statement confirming Mario's assessment. We took the serial number off of the engine and had a friend at Toyota trace it for us.

The engine isn't from JAPAN as advertised but taken out of a car in Texas in l999. This, alone, is in violation of the Texas Deceptive Trade Practices Act, Business and Commerce Code. We have filed reports with the BBB of Houston (78 reports already filed against them this year), Attorney General of Texas, Federal Trade Commission (since they conduct business over the internet), and the FBAA, who provides them with their "Seal of Approval" on their website. I only wish that we had checked them out better before purchasing from them.
