Will not return deposit after we returned the vehicle

Thank you usacomplaints.com Report! I got my $2000 Refund check that Bell Road Mazda did not want to give me back!

My fiance bought a car from the auto mall. Two weeks later they told him he was not financed. They tried refiancing him but after they gave us the run around with talking to the finance manage after the second contract was signed we returned the car.

The first contract he put down 2,000 and the total price was 13,000. Then after that didnt work they raised the interest rate and the total price to 17,000. They also wanted an extra 1,000 down. Mike side forget it. He got a car somewhere else and that delearship returned the other car for him.

The day the car was returned Mike went down to the dealership to get the down payment 04-7-05. The sales mananger Dallas Berg said no problem come back on 04-08-05 at 10am and they will have his check ready. When Mike got there they made it look like they were looking for it.

The salesperson Miguel tried to make another deal with him. Mike said no I just want my money back. Then he was told they would charge him for renting that car. After that they told him there was no one there to write him out a check. Mike told them he would take them to court. They said fine take us to court. He hasnt heard anything since then.

Bell Road Mazda kept promising a check, but after several conversations back and forth with consumer complaints Auto Advocates the dealer finally promised to give back the money that was due to me. The dealer then kept stalling and would not give the money back until the phoenix Police arrived. The Auto Advocates called the the local police to do a "civil stand-by", which they recommend whenever you feel there could be a possible confrontation or have a disagreement with a business so they cannot make false claims against you, very common, just like they did to us today. When I first arrived with my father-in-law, one of the salesmen (with his hat on backwards) threatened to "kick our ass" if we did not leave the premises.

"Car dealer's "Hot Dog" General Manager with check in hand lied to us, the check would not be ready for another 3 hours, but, when the cops show up, the check seemed to be ready.
