Corporation Can't seem to find money when its time to give it back, TX

Our mortgage was sold in 99 to EMC without warning. We continued to send our payments to the old mortgage co., after 2 months they told us we were sold. EMC had already started charging us late fees and reporting it to our credit reports before we had even known they owned our mortgage.
When we closed on our house we had a repair escrow of $2200 at the time of closing. When we releized they now owned our mortgage I called to get the escrow back. They said they had it and the painting terms still applied.
We also had a problem with them not paying our taxes, we live in a very small town so it seemed that everyone knew that our taxes were past due but US. We did get that straightened out but then our escrow doubled. When I called to find out why they said they had to cover the insurance we refused to carry. We had insurance. The same insurance co. We started the house with in 99 .
After all of these proplems we are currently trying to refinance. It took us 1 1/2 to get someone to even consider us to refinance because of what they have put on our credit report. We have not been late and have the cancelled checks to prove it. The bank cleared the checks and they still had not posted them for another month.
Now that we are refinancing, they have assessed that we owe them $122.50 in corporate fees for 4 letters at $ 20 a piece sent four days apart for a payment that was never late. They also cannot find our repair escrow and have given us several excuses to what happend to it.
I will give them the 30 days after the closing to send that check to me or I will sue them for a lot more.
