Ripoff paid off unregistered HUD MIP insurance can't get my money back

We bought our house in 1998. We had a FHA Loan with Countrywide. (yeah, they were OK) We refinanced this loan with National City Mortgage in March. It was also a FHA insured Loan. On Feb 2, we refinanced this loan with another company eliminating our MIP insurance. We recieved a letter from National City Mortgage that we were intitled to a refund from HUD on our MIP. Here's where the mess begins.

The FHA Case # that National City sent us was not correct. After looking through our original loan papers, we found the correct case #. We contacted HUD for our refund... Well it turns out that National City never registered our loan. (they applied for a case # and sent in a copy of the appraisal, but thats it!) So HUD says it doesn't have the $2286.75 that we paid in at closing or the $63.87 a month we paid in for 34 months because they never got it from National City Mortgage and even if they did get the money, since National City Mortgage cancelled the registration after we paid off their loan, I have to go through National City to get my money back. We're talking over $4000.00 of MY MONEY.

I have talked to HUD, who immediately sent us a refund from our orginal Countrywide loan. (Was a credit on my NCM closing papers) They show a case # for us with National City Mortgage, but no $.

So now here it is August 3, I have been going back in forth between HUD and National City for over 6 months. National City has made tons of promises but there have been no results. I have been told by Jesse, Nina, Shawna, just to name a few, that they will get it straightened out and call me back. I'm still waiting.

Yesterday, I requested proof that they sent in my 63.87 a month to HUD. Which department of HUD they sent it to and what case # it was under. You would think they would have records of that, right? After 1 hour of waiting on the phone, I was informed they could only fax me a copy of the last 3 months. Well I'm still waiting for that Fax. I have called National City Mortgage 2 x since then and left messages but no one has returned my calls.

The fact of the matter remains... This is my money and i want it back now. (I think I should get interest, too! And something for all this anguish they've put me through) National City Mortgage screwed up and they need to correct this matter. NOW!

At this point we are considering a class action suit.
If you have a FHA insured loan with National City Mortgage, and they are charging you MIP on your monthly payments. I suggest you find your FHA case # on your closing documents and call HUD to make sure your loan is insured.
