Took $49.95 out of my checking acct. And promised to replace it and never did

Clear Credit hit my checking account on April 16. I called and advised them that I never signed up to get a copy of my credit report and I was advised that I would receive a check within 8 to 10 weeks. It is now July 27 and it has been 3 months and they will not return my phone calls nor have I received my money. I know that $49.95 to some people is nothing but to a single parent with two children it means food on my table. I need my money and I am tired of waiting. My other question is, how many other people have they done this to. They stole from me and I want justice.
