Emc Mortgage
Has been in foreclosure since 1999 and still they won't back down. Rip-off!

EMC purchased my mortgage from United Mortgage Co while I was in Chapter 13, but I was never told. I tried calling the bankrupcty trustee and was told that they couldn't tell me anything till the chapter 13 was dismissed. My last payment to the Courts was 10/9. I kept calling the courts to get my history of payments about once a week, for 2 months. (I got the dismissal papers, from the courts on March 10) I had to get my credit report to find out who held my mortgage.

I then wrote a letter to the president of EMC. About a month later, someone from EMC called me and told me that there was nothing that could be done till the courts released us. To make a very long story short, we signed a forebearance agreement, 1/17. We found 2 different companies that would refinance us, but EMC attorney's would not give a pay-off amount.

Here it is June and nothing has been settled. They call with recorded messages, send people to check and see if we are still living then. Over a year later they send back cashiers checks that I have sent to them. They say we owe $188,000, our orginal note was for $111,000. I have never recieved the history of payments in the years that have passed, even though I have asked hundreds of times. I have proof of the payments through the Chapter 13 courts and cashiers checks. Like everyone else on this list, they have been rude and mean to me.

My house is valued at over $225,000 and they want it badly. We went to a hearing April and the judge told them to get their numbers right. It is now 14 months later and still they have done nothing. We all need to get together and file a lawsuit. I will fight with my last dying breath. They call me every 2 or 3 days, with a human, instead of a recording now. They keep telling me dates of the sale, but when I go online with our locate county, it's not there. No foreclosure date set, EMC
is trying to keep me up-tight (which they are).
