Fraudulent billing and forclosure

June my chapter 13 was discharge. When i called countrywide to get a payoff for a refinance that i was working on, i was told that our loan was in forclosure status because we were 11 month behind in payments.

I could not belive this, i have been paying my payments on time for the past 4 years that i have been in bankruptcy and now i'm being told that i'm 11 months behind. I was told that they haven't received a payment since november.

If anyone knows while in bankruptcy you must pay your mortgage on time in addition to any payment plan payments that the trustee pays.

So where has my money gone??? I asked. So for the past 3 months since july to october i have explained my story to 5 or 6 different individuals.

Each one of these people have given me a different past due amount for different months.

One stated that i was behind 6 payments since 2000. Are they hiring elementary school children to do the accounting?

Finally i got someone to tell me that my account is going to be audited and faxed my copies of cashed checks, moneyorders and so on to 4 different people.

In the mean time all my mortgage payments from july to october have been returned to me because my loan is in forclosure. Is this a setup or what.

I waited 1 month for them to do an investigation to tell me that 5 of my payments were not claimed under my chapter 13 by countrywide. Who fault is that mine or theirs.

When i filed chapter 13 the courts send a letter to countrywide asking them to claim all amounts owed.

Is it my fault that their account department screwed up? Then we went through the other 5 payments they say they don't have, for which i had copies of checks and moneyorders.

I was told that if their accounting department is unable to find the payments then we must repay the amount again.

I've already paid so why should i have to repay for checks and moneyorders that have been cashed.

I know what the problem is the housing market has gone up and my house is worth 2 times what i purchased it for so they want to take my house from underneath us and ofcourse make a profit.

I will be reporting this company to the veterans affairs department so they can lose the right to sell to veterans and be an approved va lender.

This company needs to be stopped before they try to rip someone else off.
