Check Not Posted After Foreclosure Began, Plan Cost Over 1k

My wife and I had gotten a little behind and were working on getting it fixed. We had agreed to a repayment plan and were waiting on what to send as payment amounts, but never received anything. I decided to just send the entire amount that was owed. We talked to them on March 4, 2011, to get the amount (we made a verbal agreement), and sent them a check on March 16, 2011.

They would not post the check since the loan had gone into foreclosure and the payment was not a certified check or money order, which they had not stated. This was on March 10, 2011 (we did not find out until March 22, 2011). We then had to pay over 1k to get into a repayment plan, and we are still waiting on the paperwork. We now have to pay almost 200 more than our loan amount, plus lawyer fees, to get caught up. I would like to see if we could get on board with this lawsuit.
