Ripoff on escrow refund "check's in the mail" since May '03

I refinanced in April with another mortgage company. Fairbanks requested May mortgage payment and this payment would be credited at time of closing but that the interest on this payment would be reimbursed at $22.76 per diem.

2 months went by and I called to get the status on the check. Fairbanks claimed that they had mailed the check on May 24th. (we were in July when I called). Stop payment was supposed to have been issued on that check and that I would have to wait 30 days to get confirmation that the check had not been cashed.

August, September, October, November - I have spoken to every supervisor who have claimed they will take ownership of this problem and not delegate to someone else and they would call me back. (I will say this. They are very apologetic but the problem has not been resolved)

I spoke with Michael Graham today who said he will call me back when he gets an answer from the "Refund Dept."

Can I get the money plus the interest they are earning on my money? Frankly, I'd settle for the check and forget that Fairbanks ever existed.

I will contact the Attorney General's office here in Jacksonville and the Better Business Bureau, but I'd like to know if anyone has other suggestions for me to help in this situation.
