Chapter 13 payments ignored, stay lifted and foreclosure sale set

I need some immediate help. I was so surprised to find out all the complaints about Fairbanks. I have told my story so many times with no results. People just look at me like I am lying about the situation. Just like others, I was sold to Fairbanks Capital from WMC Mortgage Company.

My life has been a complete nightmare since I've been with Fairbanks. I was first told that I was $4,000 behind and I didn't know what else to do, so I filed Chapter 13. But the mortgage company's attorneys kept saying that I had not made my Chapter 13 payments, which were coming directly out of my check. Then after I gave proof of that, they said I was not making my mortgage payments. I sent them a Western Union for $1,165.00, a two-month payment, and they claimed they never got it despite the receipts I sent them from Western Union. They went to court and the judge lifted the automatic stay.

Now I am supposed to owe $20,000 in back payments, regardless of the fact that they were getting Chapter 13 payments and I was making my regular monthly payment of $579.00. They never added any of that money to my loan. So I applied for a loan modification, which was denied because they wanted me to pay a $2,200 monthly mortgage payment and I could not do that. So now they are foreclosing on the house. I have a sale date of November 13. But they called and asked me if I would do a forbearance for 6 months while I sell the property. I agreed because I am trying to buy some time to figure out something.

They want me to continue paying my mortgage payment during the forbearance. I would go back and file a 13 to give me some more time, but they put a 120-day refiling block on me, so I could not refile to save my home. I don't want to sell my home. I have put everything I have into this house. I don't have anywhere for my daughter, my granddaughter and me to live if we are foreclosed on. I have tried to refinance over and over again, but like everyone else, Fairbanks has put so many negative things on your credit that you can't even refinance.

Is there anyone out there who can help us out of this Fairbanks nightmare? Someone must be willing to refinance us and let us get a fresh start. I have spent so much money on attorneys and sending money to Fairbanks, and still I am in foreclosure.

Please, if you know of anyone who would be willing to refinance due to the horrible way Fairbanks has treated us, please ask them to call.

And everyone is correct about the treatment they give you. You never talk to the same person. One tells you one thing and the next person tells you something else. Can't we get a class action lawsuit against Fairbanks and Pierce and Associates, the attorneys who allow them to do all these deceitful things?
