Liars, theives, kept "good faith deposit"

We started off like anyone else, looking for a good deal. Christina Roman (the secretary for CapSouth) answered our call about the property and put us in contact with Pam (with OK Close), who allowed us to look at the house. No one had any answers and had to " get back with us"... I should have known from the begining.

The house was a pre-forclosure that was purchased from Regions Bank... Or so we were told. CapSouth was in the process of obtaining a clear title, which never happened. We settled on a price and were told that we had to sign a contract and put down a "good faith deposit." All we had at the time was $4900... So we wired them the funds.

After bending over backwards getting James MacMinn (the loan officer), of 1st Guaranty Mortgage Co, W-2's, paystubs and such, we were not approved, even though we had a preapproval letter. They kept saying, One more day, we should know something tomorrow... All of this was BS!!! Even after our said closing date had passed, Joe (the head loan officer) called us to say he had gotten us approved. We had had enough, and told them to give us our deposit back!!! We provided banking info for a wire, even gave our FEDEX account number to have it picked up... All to no avail. They keep saying the check has been put in the mail.

WAIT... Where did they mail it??? They knew we had to move because our house had sold and they didnt hold up their end of the deal.

So here we are ZERO money in the bank, had to relocate a 2 year old... Did I mention my wife is almost 8 months pregnant!!!
