Broken promises about a 401(k) loan letter as foreclosure begins

I unfortunately have to say that I am a victim of Fairbanks Capital also.

I have been trying to work with Fairbanks on our loan for several months now. It came down to us being three months behind on our house payment. In those three months, we were trying to get them to send a letter to us or to my husband's employer so we could get a loan from his 401(k), and just like everyone else, they made promises and never came through.

I have also done everything I could to get the information to my husband's company so we could get this taken care of. On February 24 I finally talked to a gentleman by the name of Stan (from Fairbanks), who promised me that he would get everything I needed to my husband's 401(k) people within 2 working days. Guess what: he NEVER did. He even knew exactly what I needed and who he needed to fax it to. Wow, this guy is really going to get this done. He even told me that he would let his supervisor know of all the problems I have had. Trust me, by this time of course I did not believe him, and I would hold out until I talked to the person at my husband's work. I'm sure glad I didn't hold my breath.

I do take complete responsibility for not being up to date on my monthly payment. My husband and I have had a really rough two years. I gave birth to our last child at the end of 2001. We have four children, and I had gotten laid off from my job a year and a half before our last child, so yes, things have been very financially tough. Every time I think we are going to be fine, something else happens. And of course, as a mother and wife, I blame myself for not having a job.

To top all this off, I called this Stan guy this morning (like he told me I could) to see why he had not faxed the letter to my husband's work, and I got some lady on the phone. Of course she told me I couldn't just call in and ask for a certain person, because that's not how it works. I said that Stan had told me that I could ask for him, and she continued saying that's not how it works.

So you could probably guess that I started raising my voice and asking why Stan would tell me this and lead me to believe that all I had to do was talk to him and he would "take care of things for me" (his words the first time).

I ended up hanging up on the lady. I was just furious! I have had the run-around too long!!! I calmed down and called back a few hours later and talked to another guy and told him the whole story about Stan and asked what I can do to get this taken care of. He now tells me that we owe $3,100.00, because it went into foreclosure today. I said, imagine that! I am sure it is because of my phone conversation with the woman this morning. And guess what: I had to call customer service to get this information sent to my husband's 401(k) people, so I did. She sent me to another phone number, and guess what, I got disconnected after being on hold for about 6 minutes.

I just don't understand how companies can get away with so much! This should not happen in America. Just like a lot of other people, I've been through a lot in my life, and in some way I have always found a way to deal with it, but I just can't believe this so-called company. And what is even worse, I can't believe that there are people who work for this company and do the things they do. I KNOW I would NEVER work for a company like this. Broken promise after broken promise. I would hope that people would have some kind of conscience when they lay their head down at night.

What can I do is my question to any attorney general, attorney, judge, president, whoever cares! How do I look my kids in the eyes and tell them we have to leave our home?

And another thing I can't believe is how many people have written in about Fairbanks. I about flipped.
