Currently trying to avoid paying my claim

I was involved in an auto accident almost ONE YEAR AGO. A claim was filed with Statewide Claims Service (evidently representing Old American). Within just a couple of days I was contacted and shortly an adjuster came to my house to complete the appraisal of damages. At the beginning I thought, thank goodness, an insurance company you don't have to fight for your money. Unfortunately, that is not the case.

Now a year later, I am still attempting to get my car repaired. Their insured hit me and caused the damage. I have a police report stating it was totally their insured's fault.

I reported the company to the Texas Department of Insurance, which stirred some responses from them - they lied to the Texas Department of Insurance in my situation also by claiming to have mailed a letter which they fabricated after my complaint. The letter they supposedly sent to me in February stated "In order for us to complete our investigation without a police report, it is necessary for us to confirm the facts of the accident with our insured." Well, I sent them a copy of the police report, and still nothing.

So now I have started the process AGAIN sending a copy of my letter to the Texas Department of Insurance stating STILL NO PAYMENT OF CLAIM.

The response I received was that their insured had still not contacted them and so they would settle for 80% of the amount. No way. This company has been told time and again that their insured is spanish speaking only and does not understand what to do. I actually went to these peoples home and they told me Grandma was hanging up on their calls.

Statewide knows what they are doing and they won't quit. I hope someday there are some laws holding insurance companies accountable.
