We lost most of our income and business as a result of huricane Katrina. The mortgage fell behind and we entered into a forebearnce agreement with AMC Mortgage. Prior to signing we were unsure of the start date in which we could begin payments and instructed to inform our case manager if the start date they suggested would work. We did just that and informed them that we could not start until September 06. However the original paperwork arrived and we signed it and made a payment.

A month later we recieved a letter stating we were behind, i called ou case manager and was assured that we were not and that they were adjusting the account.in December of 06 we accidentaly made two payments to the account one on the 17th and another on the 29th.

I called our case manager again but she was no longer with the company another representitive verified the two payments and checked the account status and instructed us that it would be applied to the January payment.

In February we made our payment on time but the check was sent back, I called no less than 9 times and received a recording that an account representitive names Tim would call us within 72 hours. He never did. We continued to call with the same results. We made March payment with the same results it was sent back as well as April.

It wasn't until June did we finally get in touch with a person who told us we breached our contract adn we would have to sign a new forebearance agreement. Meanwhile our credit, the additional fees, and the interest has sky-rocketed. I hired an attorney but all the bank negates any and all conversations and committments that they made to us.
