BofA changed a 6 3/4% home equity acct into a 38 % interest credit card debt

In 2003 I opened an home equity line of credit with BofA at 6.75%. They opend a checking account and a credit card for overdraft protection as well with the home equity account.

What ended up happening is that BofA never sent me any billing or payment statements on the home equity account, took the payments directly from the checking account, never sent me any checking account statements or notices of insufficient funds, and debited the payments onto the credit card.

Now, don't get me wrong here, I tried to get BofA to send me these statements so I could make the payments through my primary checking account I maintain at another bank.

I litterally went into the branch where I opened the accounts, spoke to the account manager who opened the account, as well as had her dial the phone to BofA's credit dept. Not once, but on 10 different occasions, as well as having called from my own home to try and get these account statements sent to me.

Long story short, they ran up over $10,000 in overdraft advances, fee's, and finance charges. I have paid off the home equity line of credit, as well as have paid off the principle on the credit card. I.E. The actual $'s BofA charged the card to cover the payments to the home equity line, but I have refused to pay the balance transfer fee's and finance charges to the tune of $4,100. I am currently in dispute of those fee's, and BofA wants to settle for $2500.

Does anyone know what recourse I can follow to eliminate all these fee's and the serious dings to my credit score? Further, can I sue BofA for what I feel is illegal fraud and totally dishonest lending practices?
