Allowed fraudulent credit card checks

I have a separate Bank of America (BofA) credit card account from my wife. I have had the account from before I was married to her. My wife is not on the account never was and I did not give her permission to use the account. The account was dormant for a year or two. BofA sent out in the mail credit card checks for the account.

Oct I was legally separated from my wife.in April my wife decided to use the account without my permission and signed 3 credit card checks with my name and cashed them for $28K. BofA never contacted me to verify the first check of $20K nor the next 2 checks for $4k each and the signature did not match mine. BofA just cashed the checks without question or verification. The transactions were within 2 or 3 weeks.

When the April account statement came in I contacted BofA to dispute the charges. I explained that I thought my wife made the charges without my permission. BofA said "too bad" Mr. You still owe the money even though you never signed the checks nor approved the transactions. "Your wife is your responsibility." To date they are claiming I owe the money.

During a divorce hearing I negotiated that my wife pay the debt on this card thinking that BofA would do the right thing if someone was willing to take responsibility for the debt. I sent in all the proper paperwork and the divorce documents stating she would be responsible. BofA refuses to drop me from the debt again stating I am responsible.

I want to sue for negligence in allowing these credit card checks to be cashed and if possible bring a class action suit against them.

There has to be others out there that BofA did this to.

Also any good Lawyer would be great to hear from in the SF Bay Area. I refuse to let this go.
