Cashed my cheques but refused to credit my account telling IRS that I kept money as income

Opened account in September and used the card three months. Paid in full within their 'grace period' and when in the third month they sent a notice that none of the months had been paid I sent copies of the cancelled cheques to them and called the number I had for them at the time.

Their employee said that she saw that the cheques were cashed by CapitalOne but were somehow not credited. Stating that she had not the proper authority to correct the computer information suggested I call a supervisor; which I did do.

The supervisor said that he couldn't get into the system to correct the problem and suggested that I cancel the card with the instruction to CapitalOne that I would not pay the monthly fees or use the card again until the problem was corrected.

I have been sent to dozens of collection agencies and to each I send copies of the cancelled cheques and most will at that point let it go. The last four collection agencies told me that I had to pay it again before they would stop bothering me. I told them that if it didn't work the first time, then what guarantee would I have it would work this time?

I finally asked who oversees CapitalOne in an official government type capacity and was told that though the business was in the United States, it was overseen by a company in Canada, and they gave me a phone number. When I called, the person I talked to said that it was ridiculous for CapitalOne to say that a Canadian office would oversee an office in the United States and that he didn't even know where in the United States the CapitalOne headquarters would be. I asked if he would put this all in an email so I could send it to CapitalOne if I needed to and he agreed.

CapitalOne has been hassling me for all this time and the bill keeps mounting and they still refuse to acknowledge the cancelled cheques, turning me in to the IRS tantamount to theft.
