Misrepresentation of contract and services, Non-cancellable lease fraud

My wife and I own a business and signed a contract with a fast talking sales man to provide us credit card services. After a couple month's of repeated problem and no resolution we attempted to break out of the contract due to there lack of service.

One year later they have been beating our doors down to get money but still have never called back to help with the system, we now have an order to appear in court to pay them the total of almost $5k to satisfy a lease that they never deleivered on. My attorney has no idea what to do with it and recomends paying them because it would be the cheapest alternative. We don't know what to do at this point.
