Select Portifolio Servicing, I have had a mortgage with since 1996. They placed my loan payments in escrow and called me at work to tell me I was late and in foreclosure. I am now in bankruptcy, (13) and they won't let me pay off

I have been in a Chapter 13 bankruptcy for the last 3 years because I didn't want SPS to win. They harrassed me at work because I had late payments only to find out when I called the foreclosure department that I had 4 payments in Escrow. They said that since I didn't tell them what to do with the money, they held it!

Even though they then applied the money, they said that I was still responsible for the late fees! Then they added late fees on to the later fees which finally led me to making a deal to "catch up" my mortgage. To the tune of $12,000, I agreed and began making double payments. Well, you know that didn't work. I finally went to a bankruptcy lawyer and asked for a Chapter 13.

The lawyer said I didn't owe enough to declare bankruptcy, but agreed I was going to loose my house. We worked on it and finally dragged enough together to ask for a 13.

Now, 3 years later, I am trying to refinance through another mortgage broker, a 30 year fixed rate FHA backed loan at 6% instead of 13%. SPS won't even give my lawyer or the mortgage company the time of day.

So here I am, waiting to get away from these people and they are giving others the same run around I have put up with for years.
