Ripoff Forcing Good People Into Foreclosure In Memphis, Tennessee

I hope someone can help shed some light on this sticky situation.

I first purchased my home in 1997. I had never bought a home before and knew nothing about it. My real estate agent screwed me tremendously. Unfortunately she didn't tell me that she misled me into signing a $13,000 lien with the property owner. I didn't find this out until when I refinanced with Ameriquest (AMC).

"Ted", the agent at Ameriquest "helped" me to get refinanced. Ameriquest paid $6000 to the lien holder, the decendants of the deceased previous homeowner. My purchase price was now $82,500 with a 9.99% interest rate. The appraisal value was $107,000."Ted" also told me if anyone asked me who "John Doe" (the lien holder) was, just say that he was a creditor. They set me up with $150 per month payments to the lien holder.

Well, to make a long story short, I got ill during the middle of 2006 and fell one month behind in payments. I didn't know that Ameriquest refused partial payments. So this put me into further debt. On 10-31-06 I offered $1100 of the $1399 for Sept. And Oct. Payments but they refused. Now I owe 3 months and found out on 10-31-06 that I have to 11-7-06 before foreclosure proceedings will begin. I have $1800 now to offer them but still will not accept. I am approximately $300 short and they told me that I didn't qualify for the payment plan.

I have struggled very hard to get this home and I'm trying to keep it; however, it seems almost hopeless. I got screwed so bad when I first purchased the house and it seems everyone wants to take their turn.

I'm considering filing chapter 13 but I don't want to get caught with a huge mortgage payment because this is an adjustable rate mortgage and I almost lost my home once before through chapter 13 because they were sending my mortgage payments to some apartments instead of my mortgage company.

I thought Ameriquest was helping me because my last mortgage company raised my note from $652 to $1154 dollars per month. Now I feel the same is happening all over again.

My time for foreclosure is next week, so if anyone can help I would greatly appreciate it.
