Mortgage Loan RIP OFF. False Truth in Lending Statements

I went to these guys to refinance my home. I had less then desirable credit. I had also just come out of a bad divorce. I was late on my house payments, and getting close to forclousure. They told me, no problem, we can get you a loan, and they did. It took them nearly 3 months to put the deal together.in the meantime, the forclousure clock is ticking. And ticking LOUD!

Finally, I got all the paperwork, all the disclousures, and it all looked good. I was even able to net nearly $20,000.00 in cash out to me. I was thrilled. I had medical bills I needed to pay off, as well as getting my kids new cloths, and fixing my car.

Ok, so i go to sign papers, and guess what? The cash back to me was only at $13,000.00. I was stunned. But the deal was, that I had to sign the papers, so they could be fed exed that same day. The Title Officer told me, that I had a 3 day time period to resend the loan. Meaning, i could try to work it out, and if not, I was not obligated to the contract. So i signed the papers.

I went home, and called Bret lawrence. The owner of Excel Funding. I got his voice mail, left him a message, telling him no way, and that he needed to call me back. The next morning I get a call from him, saying Congrads Cindy your loan has funded. I said wait a minute, I have 3 days to change my mind. He said, oh no, you signed that right away.

I ended up filing a complaint witht he State of Oregon, and now after nearly 2 years of dealing with these bums, I have a Judgment in the amount of $17,000.00. But now, they are even debating that. It will all work out in the end, put people, take my advice, if you are backed into a corner, and as desperate as I was to save my house. STILL take the time to see a Lawyer. Don't sign any escrow papers, before a TRUSTING lawyer tells you it is ok to sign them.
