Countrywide Steals Home after refinance

After having many problems with country wide home loans over a 3 year period I finally Had the oppertunity to refinance my loan with another mortgage company. I thought my problems were over. But know they just got only worse. I refinanced my home and had the closing on April 26. WOW what a burden was lifted off my shoulders. Then on May 10th a man came knocking on my door, stating he owned my house, how could this be? He stated that he bought it at public auction on May 1. I told the man that was not possable and I had refinanced and had a closing on April 26. THe man was very understanding and said he didn't want to take anyones home and he would ask for his deposit back.

The next day I made phone calls to my mortgage brooker, the closing attorney and of course Countrywide. THey returned the closing proceeds stating the house was already sold. After many phone calls by the closing attorny, mortgage broker and myself countrywide concluded that they were unaweare of the refinance and this would have not happened if they were made aweare of the closing fund coming to them. How could they say this when they were contacted by the mortgage broker several times as well as the closing attorney to provide the correct pay off per deim so the proper amount could be sent to them? After many more phone calls and very little corparation with countrywide I spoke with a lady that called herself a forclouser tech.

She told me the matter was out of there hands and she could not comment, and refered me to there attorney. The attornney called me back after leaving many voice mail messages. The told me the sale was final and if the buyer asked for his deposit back he would not get it and he would loose his money if the sale was not complete. There was nothing they would or could do. I was able to contact John Smith a Vice President with country wide. I explained the problem to him as well as the buyer willing to take his deposit back. He did tell me this was reverseable and he would have to make a few phone calls. He also advised me he had spoken with my closing attorney as well this day.

April 16.2006 John Smith calls me back and tells me that he understands my problem and from a business stand point they can not reverse this because the buyer will not take his deposit back and due to the value of the property they are afraid of a recourse being taken against them buy the buyer. Perhaps the buyer changed his mind because countrywides attorny threatened him with the loss of his deposit if he didn't compete the sale. Mr Smith then concluded that this wouldn't have happenend if my mortgage broker notified them of the closing and funds being sent too them. What Rubish. What can I do I have been totally Riped Off by Countrywide.
