We came out of a chapter13 bankruptcy in 2004. EMC raised my mortgage payment to 473.11 from 367.15, saying it was for back insurance.in july we provided our own insurance and actually got a refund of 122.00 toward our account. Then they lowered our payment to 426.64. The problem is, that I have been paying 473.11 for over six months, have proof that they said what we owed was 574.00. Minus the 122.00 refund is $452.00. I have already paid over 674.00 back and they are taking the extra money that I have been sending and putting it in an escrow account, which my contract does not call for. When contacted they say it is legal, but I have contacted a lawyer which referred me to the sc comsumer affairs complaint department. I am going to file a complaint with them also.
