Ripoff refused payment & now foreclosing

Aurora bought our mortgage from National City in June. I had been with National City for over 6 years without incident. I received my letter stating that the loan had been sold and where to direct my payments. I made my first payment to Aurora without any problems, then before my second payment was due I was notified that I had supposedly missed a payment while I was with Nat. City.

When I contacted Aurora about the letter and their demand for the payment plus $2,000.00 in late fees I was told that it was for March of the same year. I sent them a copy of the cancelled check and then was told that it was not March but a a different month, we went through this several times. I finally just sent them 3 years of cancelled checks and thought that this would be quickly resolved. Meanwhile I was instructed to continue to make my regular payments, which I did. I even offered to make the "missing" payment until we could straighten out the problem and would just credit my account. I did however; refuse to pay them over $2,000.00 for late fees. I was told by Aurora not to make this payment, that they would straighten it out with Nat. City and everything would be fine.

Well it wasn't, Aurora would no longer talk with me about the matter and would not respond to my letters, they never cashed any of my payments and returned all the checks because it was not enough to bring the loan current. My loan was never behind and I had the documentation to prove it. I did manage to have one of my calls answered and I had asked why my payments had been returned, I was told to stop sending them. Aurora was in the process of forclosing on my home and that I would have my day in court. This was 11/01, I later learned that they had filed proceedings 8/01. This was the month after my first payment was refused.

My house was then scheduled to be sold at a sheriff sale that my attorney was able to stop, however Aurora did go forward with the sale, even after a judge had ordered it not to happen. I learned this when a gentleman approached my home and asked why I was here. He had made the necessary deposit and in effect bought my home.

My attorney is working on this, but as you can see it has been a very long and drawn out process, meanwhile my family and health has suffered from the stress that this has caused. My attorney has mentioned a class action lawsuit against Aurora. I cannot believe that this company can just make the rules up as they go along.
